In short
- Mensis is not a medical device and not contraception. Predictions are estimates.
- The deen module is a tool, not a fatwa. When in doubt, consult a scholar.
- A feature that was ever free never becomes paid here. That's an enforceable term, not a marketing line.
- Subscriptions run exclusively through the App Store or Google Play. That's also where you cancel them.
- In an acquisition or bankruptcy you're entitled to advance notice and to deletion of your data before the transfer.
- You must be 16 or older.
These terms apply between you and Mensis Health B.V. (Chamber of Commerce 98765432, VAT NL867890123B01), Spoorlaan 21, 5038 CB Tilburg, the Netherlands. By using Mensis you agree to them. If you don't agree, don't use the app — and if you already do, delete your account through Settings.
We've tried to keep these terms short and readable. Where that clashed with clarity, we chose clarity.
1. What Mensis is
Mensis is a mobile app for tracking your menstrual cycle and symptoms, seeing predictions about your next period and your fertile window, and — if you enable it — recording your hayd status, ghusl moments and missed fasting days.
The app is an information and record-keeping tool. Nothing more, and that's deliberate.
2. Not a medical device, not medical advice
- Predictions are estimates based on your own history. They can be wrong, especially in your first months, with an irregular cycle, with PCOS, around menopause, or during illness, stress and travel.
- The app shows a margin of uncertainty with every prediction. That margin is part of the prediction — don't ignore it.
- Mensis never presents fertile days as "safe days" and never will.
- If you suspect a condition, or your cycle changes suddenly, see a doctor. What the app shows is not a diagnosis.
- In an emergency, call your local emergency number. The app is not an emergency service.
3. The deen module: a tool, not a fatwa
The deen module calculates on the basis of thresholds you set yourself and data you log yourself. It applies no school of law, chooses none, and pronounces no religious ruling.
- The content was reviewed by a fiqh-qualified reviewer before release. That's a quality measure, not religious authority that we would possess.
- Situations, habits and schools of law differ. When in doubt, and certainly in edge cases, consult a scholar.
- Nifas (postnatal bleeding) is not supported in this version. The app says so explicitly rather than guessing.
- The AI assistant answers no fiqh questions and never sees your deen data.
We accept no liability for religious decisions you make on the basis of the app. That isn't legal evasion but a substantive position: that decision isn't up to software.
4. Your account
- You create an account with Sign in with Apple or with Google. We offer no other sign-in methods.
- You must be 16 or older. Onboarding checks your year of birth.
- Your account is personal. Don't share your sign-in details.
- The data you enter is yours. We claim no ownership of it.
- You can delete your account from within the app at any time, without emailing us.
5. What you may and may not do with the app
We grant you a personal, non-transferable and revocable right to use Mensis as intended. Not permitted:
- Attacking, overloading or attempting to break into the app or our systems
- Seeking access to other users' data
- Cloning or decompiling the app, or reusing parts of it in your own product
- Using the app in a way that breaks the law
- Extracting data from our services in an automated way
Security research, on the other hand, is welcome. If you find a vulnerability, report it to support@mensishealth.com before disclosing it publicly. We'll respond and keep you informed about the fix.
6. The free-stays-free promise
New features we build later may be paid. The distinction is simple: what you already had, you keep.
7. Mensis Plus, payment and cancellation
Mensis Plus is an optional subscription with additional features. At the time of writing it isn't for sale yet.
- Purchases run exclusively through Apple's App Store or Google Play. We sell no subscriptions through a website and never ask for your payment details.
- The price and the term are always visible before any trial begins. If a trial rolls into a paid subscription, we announce that in advance.
- You cancel through your subscription settings at Apple or Google. We can't do it for you — that's a limitation of the stores, not a choice of ours.
- Refunds follow Apple's or Google's policy. If that gets stuck and you think it's unfair, email us and we'll see what we can do.
- Deleting your Mensis account does not stop your subscription. Cancel it separately in the store.
If you buy as a consumer in the EU, you have in principle a statutory 14-day right of withdrawal. For digital services that start immediately, that right can lapse once delivery begins with your express agreement. In practice the handling runs through the store where you bought.
8. Your data
How we handle your personal data is described in the privacy policy. Two commitments are repeated here because they are contractual, not merely informative:
- We do not sell or rent your data, to anyone, ever.
- We show no advertising in the app and share no data with advertisers or data brokers.
- We train no models on your data and contractually do not permit our suppliers to do so.
9. Intellectual property
The app, the name Mensis, the logo, the design, the copy and the underlying software belong to us or to our licensors. You may not copy, modify or reuse them without written permission.
What you enter in the app stays yours. You only grant us the right to process that data insofar as necessary to make the app work.
10. Availability and changes
We do our best to keep the app available, but guarantee no uninterrupted operation. Maintenance, supplier outages and bugs are part of software.
We may add, change or remove features. If we remove a feature you were using, we announce it in the app beforehand and, where your data is involved, offer an export. If we discontinue the service entirely, you get at least 60 days to export your data.
11. Liability
Mensis is provided as it is. We are not liable for damage arising from inaccurate predictions, missed or incorrect use of the app, loss of data not caused by us, or decisions — medical, religious or otherwise — that you make on the basis of the app.
This limitation does not apply in the case of intent or wilful recklessness on our part, nor insofar as mandatory law — including Dutch consumer law and product liability rules — does not permit a limitation. If you are a consumer, these terms do not affect your statutory rights.
To the extent we are liable, our liability is limited to the amount you paid for Mensis in the twelve months before the event causing the damage, with a minimum of 50 euros.
12. Termination
- You can stop at any time: delete your account in the app and remove the app from your device.
- We may suspend or terminate an account for abuse of our systems or for acting contrary to these terms. We'll tell you why, unless the law prevents us.
- Where we terminate, we'll give you the opportunity to export your data first wherever possible.
13. Acquisition, merger or bankruptcy
This is the weakest point of any model resting on promises rather than technology, which is why we spell it out instead of leaving it out.
If Mensis Health B.V. is acquired, merges into another company or enters bankruptcy, the following applies:
- 1.Your data transfers only to an acquirer who binds itself in writing to these terms and to the privacy policy as it stands at that moment.
- 2.You are informed before the transfer, with a reasonable period of at least 30 days.
- 3.Within that period you can delete your account and all your data, so that nothing transfers.
- 4.An acquirer may not use the data for advertising, may not resell it and may not train models on it. If an acquirer wants to, that is a material change requiring fresh, explicit consent.
14. Changes to these terms
We may amend these terms, for instance when the app changes or the law requires it. For a change that is to your disadvantage, we give at least 30 days' notice in the app.
If you disagree with a change, you can delete your account within that period. If you use the app after the effective date, the new version applies.
15. Governing law and disputes
Dutch law applies to these terms. Disputes are submitted to the competent court in the Netherlands.
If you are a consumer, you retain the right to go to the court of your place of residence and to the applicable mandatory consumer protection of your own country. You can also use the European ODR platform, though we'd rather resolve it with you directly.
